Share The Dream, Inc., producer of Journey To Legacy (“Share the Dream”, “we”, “us” or “our”) welcomes you and invites you to access and use our websites, including, without limitation, journeytolegacy.com and programs.journeytolegacy.com (the “Websites”), and our associated products and services (collectively with the Websites, the “Services”), subject to these Terms of Service (these “Terms”). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to any of these terms, please do not use the Services.

Eligibility. You must be at least 13 years old to use the Services. By using the Services, you represent and warrant that you meet this minimum age requirement. If you are a minor, you acknowledge that you have a parent or guardian’s permission to use the Services and agree to these Terms.

Account Registration. If you request to create an account with us or if someone invites you to use our Services, an account may be created for you, and you will be required to provide certain information. You must provide complete, current, and accurate information about yourself as requested and keep that information up to date. You are responsible for safeguarding the confidentiality of your account information and for all activity conducted using your account. Please notify us immediately of any unauthorized use of your account.

Acceptable Use. You may use our Services only as permitted by law. You agree not to misuse our Services, including by: (a) accessing or using our Services to abuse, defame, slander, harass or threaten anyone; (b) sharing any materials that are obscene, inappropriate or objectionable, such as pornographic, racist, malicious or violent materials; (c) using the Services to transmit viruses or similar destructive items; or (d) interfering with our Services or a user’s ability to access them, such as by hacking or accessing another user’s account. We may suspend or terminate your access to the Services at any time, including if you do not comply with these Terms or any other policies, or if we are investigating suspected misconduct.

User Content. When you upload or provide written materials, photographs, voice and/or video recordings or other content (collectively, “User Content”), you retain ownership of any intellectual property rights in that User Content. By submitting User Content, you grant Share the Dream a worldwide, perpetual, sublicensable, and transferable license to use the User Content to provide the Services and for any other purpose you have agreed to. You represent and warrant that you own or have the rights to share the User Content and to allow us to use it as set forth herein, and that the User Content will not infringe, misappropriate or violate the intellectual property rights or other rights of any third party.

If you submit videos or photos to be used by Share the Dream for marketing purposes, you must obtain permission from all individuals appearing in the User Content. If any such individual is under the age of 18, you must obtain permission from their parent or guardian.

We are not responsible for any loss or removal of your User Content, so please keep back-up copies. If you submit feedback or suggestions about our Services, we may use your feedback or suggestions without obligation to you.

Third-Party Services and External Sites. Our Services may display content that is not Share the Dream’s and/or direct you to sites, software or services owned or operated by third parties (“Third-Party Services”). While we take great care to only work with trusted Third-Parties, we have no control over and are not responsible for the content, operation, privacy practices, or other policies of such Third-Party Services. Your use of Third-Party Services is at your own risk and subject to the terms and conditions of the applicable Third-Party Services.

The Websites may also contain links to third-party websites (“External Sites”). These links are provided solely as a convenience to you and not as an endorsement by us of the content on such External Sites. We are not responsible for the content of linked External Sites and make no representations regarding the content or accuracy of materials on such External Sites. If you decide to access linked External Sites, you do so at your own risk.

Medical Disclaimer.  The information, programs, or services offered by Share the Dream are not substitutes for professional advice or treatment, including the advice and treatment of a licensed healthcare professional. Share the Dream’s guides are not psychotherapists, psychiatrists, financial analysts or experts, entity experts, employment agents, or business managers. The products and services offered by Share The Dream are not suited for everyone. If you have any current mental health conditions, are taking prescription medications, or are under professional care or supervision, it is your responsibility to notify us, as our Services are not a substitute for such treatment or care. Never disregard the medical advice of a psychologist, physician or other health professional, or delay in seeking such advice, because of information offered through the Services.

Intellectual Property Rights. Share the Dream retains all intellectual property rights in the Services, except for User Content. Using our Services does not grant you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services without permission from its owner or as otherwise permitted by law. These Terms do not grant you the right to use any branding or logos used in our Services without our express written permission.

Purchasing and Payment. If you purchase products through the Websites, you agree to pay Share the Dream all applicable fees and taxes, and you authorize us (or our third-party payment processor) to charge your provided payment method. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We may change our prices at any time. All payments will be charged and made in U.S. dollars if your mailing address is in the United States, or in your local currency if your mailing address is outside the United States. Disclaimer of Warranties.WE PROVIDE OUR SERVICES USING A COMMERCIALLY REASONABLE LEVEL OF SKILL AND CARE, BUT THERE ARE CERTAIN THINGS THAT WE DON’T PROMISE ABOUT OUR SERVICES. OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS, SHARE THE DREAM DOES NOT MAKE ANY COMMITMENTS ABOUT THE SERVICES, INCLUDING THEIR CONTENT, FUNCTIONALITY, RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SERVICES “AS IS”.

SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.

Limitation of Liability. TO THE EXTENT PERMITTED BY LAW, SHARE THE DREAM, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR CONTENT; FINANCIAL LOSSES; OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF SHARE THE DREAM, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIM UNDER THESE TERMS, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICES AGAIN).

YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH ANY PRODUCT PURCHASED IS TO OBTAIN A REFUND, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH ANY OTHER PORTION OF THE SERVICES IS TO STOP USING THE SERVICES.

IN ALL CASES, SHARE THE DREAM, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

Copyright and Trademark Issues. While we are not obligated to review Content for copyright or trademark infringement, we are committed to protecting copyrights and trademarks and expect users of our Services to do the same. The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law.

The DMCA also requires that we notify you of how to contact us if you have a concern about the infringement of your rights and prescribes the form that notice must take, as set out below.   • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the material claimed to have been infringed, and enough pertinent information about the location of the material to enable us to locate it within the Services;
  • Your contact information, such as an address, telephone number, and, if available, an email address;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Indemnification. You agree to defend, indemnify and hold harmless Share the Dream from all damages, losses, expenses (including reasonable legal fees), claims, suits, or actions related to your breach of these Terms or violation of applicable laws.

Modifying and Terminating Services. We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend, add limits to, or stop a Service altogether. You can stop using our Services at any time, although we’ll be sorry to see you go. We believe that you own your User Content and preserving your access to such User Content is important. If we discontinue part of the Services, where reasonably possible, we will give you reasonable advance notice and a chance to get your User Content out of that part of the Services. We have the right to terminate your account for any reason. If we choose to terminate your account, we’ll send you a digital backup and refund all non-book purchases.

Changes To These Terms. Share the Dream reserves the right to revise these Terms at any time by posting an updated version to our website. You should periodically review this page for the latest information on our Terms. By continuing to access or use the Services after updated terms have been posted, you agree to be bound by the updated terms. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.

Miscellaneous. These Terms constitute the entire agreement between you and Share the Dream regarding your use of the Services. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. If any provision of these Terms is, for any reason, held to be invalid or unenforceable, the other provisions of these Terms will remain enforceable. You may not assign or transfer these Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice or consent. The section titles in these Terms are for convenience only and have no legal or contractual effect.

Disputes. You and Share the Dream agree that any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof or the use of the Services (collectively, “Disputes”) will be settled by binding arbitration, except that each party retains the right to bring an individual action in small claims court and the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents or other intellectual property rights.

The arbitration will be conducted by the American Arbitration Association (“AAA”) under its rules, including the AAA’s Commercial Arbitration Rules. The arbitrator shall have exclusive authority to resolve all Disputes. The arbitrator’s award shall be final and binding on all parties.

You and Share the Dream agree that any arbitration will be limited to the Dispute between Share the Dream and you individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class-action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons. If a decision is issued stating that applicable law precludes enforcement of any limitations set forth in this paragraph as to a given claim for relief, then that claim must be severed from the arbitration and brought in the federal or state courts of San Luis Obispo County, California. All other claims shall be arbitrated. You agree that regardless of any statute or law to the contrary, any claim arising out of or related to the use of the Services must be filed within one (1) year after such claim arose or be forever barred.
